SERVICE AGREEMENT

 CK Genealogy Research & Design

This Service Agreement is made between:
CK Genealogy Research & Design and the Client.

1. Scope of Services
CK Genealogy Research & Design provides genealogy research, record analysis, ancestral documentation, and custom graphic design services including, but not limited to:
• Family tree creation
• Historical record searches
• Ancestor tracking
• Document and photo analysis
• Family charts and pedigree layouts
• Custom genealogy design materials
Specific deliverables will be mutually agreed upon before work begins.

2. Client Responsibilities
The Client agrees to provide:
• Accurate family information and known data
• Permission to use submitted photos, documents, and personal material for research purposes
• Prompt communication and responses when clarification is required
The Service Provider is not responsible for delays caused by missing, inaccurate, or withheld information.

3. Research Limitations
Genealogy research relies on public records, archives, historical materials, and other third-party sources that may contain inaccuracies or omissions. Therefore:
• No guarantees are made regarding discovering specific ancestors, ethnic origins, or historical conclusions
• Research is performed on a best-effort basis
• Findings may reveal unexpected, sensitive, or emotionally impactful information
• The Service Provider bears no liability for personal or familial reactions resulting from discoveries

VERY IMPORTANT 

I will apply thorough and responsible research methods; however, genealogical results cannot be guaranteed. Some records may be missing or inaccessible, and therefore the exact information requested may not be located.

4. Fees & Payment
• Fees are communicated in writing prior to project commencement
• Payment terms: deposit required.
• Any additional fees (e.g., archive fees, document retrieval, certification copies) will be discussed in advance
• All payments are non-refundable due to the research labor required, except where otherwise agreed by both parties
Work will not begin until payment terms are satisfied.

5. Delivery of Work
• All work will be delivered in digital format unless otherwise agreed
• Delivery timelines are estimates, not guarantees
• Delays resulting from third-party archives or record sources are outside the Service Provider’s control

6. Confidentiality & Privacy
The Service Provider agrees to treat all personal data and family information with strict confidentiality.
• Personal information about living individuals will be protected
• Sensitive details will not be published or shared publicly without consent
• All research data is stored securely

7. Intellectual Property & Usage Rights
• The Client retains personal rights to the genealogical facts discovered
• CK Genealogy Research & Design maintains copyright over compiled research documents, visual designs, and formatted presentation materials unless otherwise agreed
• Deliverables are for personal and family use unless commercial rights are licensed separately
The Client may not resell, republish, or commercially distribute CK Genealogy Research & Design work without written permission.

8. Client-Provided Material
The Client warrants that any materials provided (photos, documents, personal data) do not violate copyright or privacy rights of others.
The Client grants CK Genealogy Research & Design a license to use such materials for research and content development purposes as needed to fulfill the service.

9. Communication & Updates
CK Genealogy Research & Design will communicate progress via email or designated communication channel.
Response times from Client affect project timeline.

10. Termination of Agreement
Either party may terminate this Agreement with written notice.
Upon termination:
• Work completed remains chargeable
• No refunds are provided for work already performed
• Any outstanding payments must be settled by the Client

11. Liability
To the fullest extent permitted by law:
• The Service Provider is not liable for incorrect or incomplete historical data
• The Service Provider is not liable for emotional, familial, cultural, or identity implications resulting from findings

12. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of:

Disputes shall be resolved in the courts of that jurisdiction.

13. Acceptance
By commissioning services from CK Genealogy Research & Design, the Client acknowledges and agrees to the terms of this Agreement.
